Chapter 1 (General Provisions)
These terms and conditions constitute the agreement for customers (hereinafter referred to as "Users") who use the services provided by SOBA Project Inc. (hereinafter referred to as "the Company"). Please be sure to review and agree to these terms before using our services.
Article 1 (Application of Terms)
- These Terms of Service for Shu Yamamoto NFT Cat Art (hereinafter referred to as "these Terms") apply to the use of the portal site "Shu Yamamoto NFT Cat Art" (hereinafter referred to as "this Service") operated and provided by SOBA Project Inc. (hereinafter referred to as "the Company"). By using this Service, you are deemed to have agreed to these Terms.
- The "Privacy Policy" and other regulations separately established by the Company shall constitute part of these Terms.

Article 2 (Changes to Terms)
- The Company may change these terms without obtaining the consent of users. In such cases, the terms of use of this Service shall be governed by the revised Terms of Service.
- The revised terms shall take effect from the time they are posted on the Service's website, unless otherwise specified by the Company.
Article 3 (Notifications from the Company)
- The Company will notify users of necessary matters from time to time through postings on the Service's website, sending emails, or other methods deemed appropriate by the Company.
- The notifications mentioned in the preceding paragraph shall take effect from the time they are posted on the Service's website when posted there, or from the time the email is sent when sent by email.
Chapter 2 (Usage)
Article 4 (ID and Password Management Obligations)
- Users shall be fully responsible for the use and management of the ID and password assigned by the Company during user registration.
- Users shall not allow third parties to use their ID and password, nor shall they lend, transfer, sell, or otherwise dispose of them.
- Users shall bear full responsibility for any damages resulting from insufficient management of ID and password, usage errors, or use by third parties.
- If users become aware that their ID and password have been stolen or are being used by a third party, they must immediately notify the Company through direct and immediate means and follow any instructions from the Company.
Article 5 (Prohibited Activities)
- The following activities are prohibited when using this Service. If these are violated, the Company may suspend service to the user or refuse future service use. Additionally, if the Company suffers damages due to a user's violation, the user shall be responsible for promptly compensating for all such damages.
- Actions that infringe upon the rights, interests, reputation, etc., of the Company, other users, or third parties.
- Actions such as impersonating others to use the service, entering false information, or other fraudulent activities.
- Collecting personal information, including email addresses, through this Service without the consent of the other party.
- Activities aimed at pyramid schemes, chain letters, solicitation emails, or spam emails.
- Actions that violate laws and regulations.
- Actions that violate public order and morals.
- Actions that infringe upon the copyrights or intellectual property rights of other companies through the use of this Service.
- Other actions deemed inappropriate by the Company.
Article 6 (Intellectual Property Rights)
- This Service and information provided by the Company to users are protected by copyright, trademark rights, patent rights, or other intellectual property rights and laws. Therefore, when using this Service, users are deemed to recognize the following matters. If these are violated, the Company may suspend service to the user or refuse future service use. Additionally, if the Company suffers damages due to a user's violation, the user shall be responsible for promptly compensating for all such damages.
- The property rights of information (including video, audio, text, photographs, and software) provided by the Company to users through this Service belong to the Company.
- Users may not reproduce, publish, lend, or reprint this Service or software, in whole or in part, without permission.
Chapter 3 (Service Interruption and Termination)
Article 7 (Service Interruption)
- The Company may temporarily suspend the provision of this Service without prior notice to users in any of the following cases:
- When maintenance or construction of the Service equipment is unavoidable.
- When a failure occurs in the Service equipment and it is unavoidable.
- When telecommunications services become unavailable due to causes attributable to Type I telecommunications carriers or other telecommunications carriers.
- Other cases where the Company deems it necessary to temporarily suspend the service.
Article 8 (Service Termination)
- The Company may terminate this Service or part of this Service for users without prior notice.
- Even if the Company terminates this Service without prior notice to users, the Company shall be exempt from compensating for any damages, losses, or other costs arising from the termination of the Service.
Chapter 4 (Protection)
Article 9 (Communication Confidentiality)
- The Company shall not disclose or leak users' personal information obtained through the provision of this Service to third parties, except in the following cases:
- When providing personal information to business contractors who are contractually obligated to appropriately manage personal information, for the purpose of entrusting necessary business for the provision of this Service.
- When aggregating and analyzing personal information for the purpose of improving this Service.
- When rights related to this Service are transferred and all legal rights and obligations are transferred to the transferee.
- Other cases where personal information is disclosed or used with the consent of users.
- When disclosure is required by a warrant issued by a court, other court decisions, orders, or laws and regulations.
- When there is a legal and proper inquiry from prosecutors, police, or supervisory authorities.
- When the Company deems it necessary to protect the Company's rights, reputation, etc.
Article 10 (Compliance with Privacy Policy)
- The Company shall appropriately protect personal information and comply with the Privacy Policy posted on this Service's website.
Article 11 (Disclaimer)
- The Company shall not be liable for any damages or losses suffered by users in connection with the use of this Service.
- The Company shall not be liable for any damages or losses suffered by users when Article 2 (Changes to Terms), Article 7 (Service Interruption), and Article 8 (Service Termination) occur in connection with the use of this Service.
- The Company shall not be liable for any damages caused by users to other users or third parties through the use of this Service, or for any damages suffered by users from other users or third parties.
- The Company makes no guarantees regarding the completeness, accuracy, certainty, usefulness, etc., of any information that users obtain through this Service from other users or third parties.
- The Company shall not be liable for any damages caused to users by system interruptions, delays, suspensions, data loss, unauthorized access to data, or other damages related to the Service.
- The Company makes no guarantees regarding the operation of any equipment or software used by users.
- Connection costs charged by telephone companies or various communication providers in connection with the use of this Service shall be managed at the user's own responsibility, and the Company makes no guarantees in this regard.
Article 12 (Claims for Damages)
- If a user causes damage to the Company through actions that violate these Terms or through fraudulent or illegal use of this Service, the Company may claim appropriate damages (including attorney fees) from the user.
Article 13 (Governing Law)
- The governing law for these Terms shall be Japanese law.
Article 14 (Jurisdiction)
- For disputes related to these Terms, the Kyoto Summary Court or Kyoto District Court shall be the court of first instance with exclusive jurisdiction, depending on the amount of the claim.
